GENERAL TERMS OF PURCHASE

The present General Terms of Purchase govern the use of the web site www.investforchildren.org (hereinafter “the Website”) which is owned by the Foundation Invest for children (hereinafter Invest for children).

Invest for children is a non-profit Foundation with registered office at Edificio Zurich, Via Augusta, 200, 1ª planta 08021 Barcelona, with tax identification number: G-63813604, and registered at the Register of Foundations of the Generalitat de Cataluña with number 2.112. By using the services of the internet store of the Store of Invest for children, the user adheres to the General Terms of Purchase of the version published by Invest for children at the moment of the purchase. Thus, it is convenient for the client to read these General Terms prior to the purchase.

1. Scope of the contract

The present General Terms of Purchase apply to the sale of all the products of Invest for children through their website to clients who can receive their orders in Spain (peninsula) and Balearic Islands, Europe and internationally. Invest for children reserves the right to cancel a client’s order when fraudulent, with speculative purpose or bad faith behaviours are detected.

2. Minimum amount
There is no minimum amount.

3. Price
The prices are the indicated on the website at the time of the order. The prices are detailed in each product, including VAT. The cost of shipping is detailed to the client apart of the Price of the product. And it appears also when adding the item to the shopping bag and selecting the destination place. Invest for children reserves the right to make any adjustments deemed necessary at any moment without prior notice, being able to update even daily, products and prices depending on the innovations that are appearing.

4. Payment

The method of payment of the purchases will be selected during the process of the purchase and the payment depending on the chosen method, will be done at the end of the purchase and it will be an indispensable condition end the purchase. The methods of payment accepted are the following.

The purchase can be done by credit cards Visa®, Mastercard®, or debit card 4B or 4B Maestro (it implies an automatic charge).

In any case, the client can choose the method of payment during the process in the corresponding screen. The client must notify Invest for children of any improper or fraudulent charge to the card used for the purchase, by sending an email or a telephone call, in the shortest possible time to carry out the necessary administrative tasks. Issuers and holders of the means of payment can adopt anti-fraud measures involving the rejection of some kind of transactions. Invest for children is not responsible of the application of this kind of security policies.

5. Delivery times and cost
All the items in the website of Invest for children are available (unless out of stock or exceptional circumstances), this let us manage order to be delivered between 1 and 3 working days from the following day to the order, via the transport agency MRW. For international orders, we will use the Post Office network and the orders re delivery between 3 and 7 working days from the following day to the order. The orders established on Fridays or holidays will be sent on the first following working day. If for any reason there would be any delay in the shipping we will communicate the new estimated delivery date.

On national orders (Spain), the client must be aware of the arrival of the Courier. In case, the client may not be at home at the moment of the delivery in the given address, the courier will leave an arrival notice indicating the telephone number to arrange a new delivery.

Two days without contact, the company will try to contact the client in the telephone number given (it is more useful a mobile number). The parcel will be sent back after five days without contact, Thus, the client must be sure to give an address where he or she may be easily accessible (work address, a relative’s, etc.)

In case the parcel be sent back by the courier due to the impossibility of contacting the client, the client will be responsible to pay for the new shipment

Once shipped the parcel, the delivery address cannot be modified.

It is not possible to specify the exact hour of delivery.

The Courier will not phone before the first delivery attempt.

If there is any error in your parcel, contact us and we will inform you about the solution free of cost.

Consult for purchases to Canary Islands.

On interaction and European shipments, if a parcel comes back due to the impossibility to contact the client, it will be the client who will pay for a new shipment.

The shipping costs (VAT included) are the following:

Peninsula – Express Courier: €7, 00
Europe – Express Courier: €15, 00
International – Certified Mail: €40, 00
COD (Cash On Delivery) not allowed.

6. Returns. Right of withdrawal
If for any reason you are not satisfied with the goods purchased in the website, you have a 14-day period from the delivery date, to return it.

To exercise your right of withdrawal, you will have to notify your decision by an unequivocal statement (such as a letter sent by postal mail, fax or email). You can use the model of withdrawal form below, although it is not compulsory.

The period for withdrawal shall be deemed to have been observed if notice of withdrawal is sent, or the goods are returned, before its expiry. (Withdrawal form).
In case of the client’s withdrawal, we will give you back all your payments, included the delivery costs (except additional costs due to the client’s decision to use a different delivery from the less costly ordinary one offered by us) without undue delay, and, in any case no later than 14 calendar days from the day on which the client informed of his or her decision of withdrawal. We will proceed to the reimbursement using the same method of payment used by us at the initial transaction, unless you had expressively provided otherwise; in any case it will not incur as any cost due to the reimbursement.

In this case, the clients will assume the shipment cost. We are not responsible of packages that we do not receive due to any loss or other cause. We recommend using certified mail or other type of Courier who can certify the delivery. To accept the devolution, both the product and the packing must be in perfect condition, without scratches or broken packing or in bad estate and including all the documents that go with the product and its accessories. The client should pack it correctly, ensuring no damage will be caused during transportation. Once our staff have received the goods and checked that they have arrived in the same condition as when they left, it will be come to the refund of the import.

7. Item availability

All purchases are subject to availability. In case of incidence or items out of stock, the client will be informed immediately and it will be come to the refund of the products out of stock. Invest for children will reimburse the corresponding import in a period of 14 calendar days. The reimbursement will be ordered by bank transfer.

8. Guarantee of the goods purchased

The contractual guarantee that applies is the Royal Legislative Decree 1/2007, of 16 November, by which the restated text of the General Consumer and User Protection Act and other related provisions was approved.

9. Invoice

The client can ask at any moment for a copy of the corresponding invoices in paper or telematic means.

Invest for children will attend your query the earliest possible date, but not later than a month. In case your inquiry has not been addressed to your satisfaction, you may have to recourse to ordinary jurisdiction as indicated below.

11. Information for buyers about the platform of E-commerce conflicts resolution

12. Applicable Law and Jurisdiction

The present General Conditions of Purchase are subject to the Spanish Law. The parties submit themselves to the resolution of disputes are subject, with an express waiver of any other jurisdiction, to the client’s tribunals and courts.
